Recharacterization of dividends into wages subject to social security charges
Arnaud Martin and Nicolas Béguin have published this month in GesKR a commentary of the Swiss Federal Supreme Court decision 9C_327/2015 of 3 December 2015 (ATF 141 V 634). Their article sets out the so-called “Nidwald practice” on the recharacterization of dividends and suggests certain adjustments to its practical implementation by the authorities in charge of levying social security contributions.

Arnaud Martin is a Swiss Certified Tax Expert. He graduated from the University of Fribourg in 2004 and was admitted to the Geneva Bar in 2006.
